地方就学における5 ptの詳細 / 6D101:Study in designated regional area qualification

オーストラリアでは長年にわたり、留学生に永住のチャンスを与えるルールを設けており、そのVISAの種類やルールは変動をし続けています。
原則はDemand Drivenと呼ばれており、特定のオーストラリアで必要なスキルを学ぶ学生にチャンスが発生しやすいシステムを導入しており、職種リストは定期的にニーズに合わせて見直し更新が行われております。

必要とされる職種での資格や経験、英語力、年齢、留学、教育資格などをポイントシステムとし、その中から選抜するシステムが年々進化しており、また2019年11月16日より地方エリアが広範囲指定され、シドニー、メルボルン、ブリスベン以外に就学する方にはより永住チャンスがを与える新しい動きが始動しはじめています。上記3大都市以外に大学、大学院就学される方は卒業生ビザが1～2年の延期も可能となるルールが2021年1月より稼働がはじまり、それにより卒業直後に申請が難しくともその土地に住み、仕事をし、英語力を高めることで可能性を広げていくことが可能になります。

Skilled Work Regional (Provisional) Subclass 491、Skilled Independent visa (subclass 189)、Skilled Nominated visa（Subclass 190 ）　

はポイントシステムのスキル系ビザとなり、現在の通過ポイントは65Ptとなっておりますが、実情、高いポイントの方からInvitationが発行されるSubclass189はInvitationは現時点では90Point　以上が必要な状況となっており、非常に狭き門となっています。

しかしながら、州スポンサーによるSubclass491, 190は州や職種によっては65Ptでも可能性がありうります。特にタスマニア（ホバート）やノーザンテリトリー（ダーウィン）、南オーストラリア州（アデレード）はより積極的に留学生誘致、永住のチャンスを卒業後の学生に与えています。

ポイントの計算方法はSCHEDULE 6D — GENERAL POINTS TEST FOR GENERAL SKILLED MIGRATION VISAS MENTIONED IN SUBREGULATION 2.26AC(1)　において明確に定義されています。

本日はその中で、Regional Australia（Designated Regional Area)にて学ぶことで得られる5Ptについて、その詳細、現時点（2020年9月1日現在）での移民局の審査方針を解説します。

※移民局の解釈やポイント自体も更新されていきますので、この解説が永続する保障は一切ありません。
その時点でのルールを常に確認することが必要となります。

Part 6D.10    Study in designated regional area qualification

Item	At the time of invitation to apply for the visa …	Number of points
6D101	each of the following applied: (a)  the applicant met the Australian study requirement; (b)  the location of the campus or campuses at which that study was undertaken is in a designated regional area; (c)  while the applicant undertook the course of study the applicant lived in a designated regional area; (d)  none of the study undertaken constituted distance education.	5

a) Australia Study Requirementを満たして就学すること

A person satisfies the Australian study requirement if the person satisfies the Minister that the person has completed 1 or more degrees, diplomas or trade qualifications for award by an Australian educational institution as a result of a course or courses:  

(a)  that are registered courses; and （CRICOS登録コースであること）

(b)  that were completed in a total of at least 16 calendar months; and  

(c)  that were completed as a result of a total of at least 2 academic years study; and

(d)  for which all instruction was conducted in English; and

(e)  that the applicant undertook while in Australia as the holder of a visa authorising the applicant to study.

原則2つの事項を満たす必要あり

①　16か月以上をかけて、認められる登録コースを修了すること
（Diploma, Advanced Diploma, Degrees、Trade Qualificaitonの場合、CIII, CIV)
注意事項：この就学に換算されないコースも存在していること

②　2 Academic year の現在の定義はCRICOS登録92週以上のコース

今までの就学、経験より単位免除にて科目の免除が行われたとしてもCRICOS登録92週であることが、査定のポイントとなっており、16か月以上をかけて、指定のコースをオーストラリアにて学ぶことが焦点となっています。

b）学ぶキャンパスがRegional Australia（Designated Regional Area)　に位置していること

現在、Regional Australiaはシドニー、メルボルン、ブリスベン以外のあらゆるエリアがRegional Australiaとして指定されています。詳細のエリアはPostcodeで指定されています。このエリア指定は今後も変動する可能性があります。

ｃ）学んでいる最中はRegional Australiaに住み続けていること

現在の審査ポリシーにはAustralia Study Requirementを満たすために使われた期間だけではなく、全コース期間と解釈する事とあります。

while the applicant undertook the course of study,, the applicant lived in a designated regional area (this requirement relates to the whole course not just the period used to satisfy the Australian study requirement) (paragraph 6D101(c)); 

Regional Australia外で過ごす時間の許容範囲に関して
（Time in Australia spent outside a designated regional area）

現在の審査ポリシーによると以下のような仕事やレクリエーション目的におけるRegional Australiaではないエリアへ行く（Travelする）ことはRegional Australia就学におけるポイント審査においては許容範囲内と判断されうります。

Under policy, it is consistent with the intention of the requirement to study in a designated regional area that a visa holder who continues to be enrolled to study, in a designated regional area and continues to reside in a designated regional area, might travel to an area outside a designated regional area for work or recreational purposes such as:

• for once-off business reasons　（1度きりのビジネス目的）
• a brief holiday or　（短期ホリデー）
• to undertake training for work.　（仕事のためのトレーニングを受ける）

(d)  コースでの就学がディスタンス教育(通信教育）ではないこと

none of the study undertaken constituted distance education.

移民局の現時点の解釈においてこのポイントはもしDistance Education Studentとしてコースを履修する場合はポイント対象外、という説明となります。
※通常、大学においてFull-time学生、Part-time学生、Online / Distance(通信）学生という仕分けがされています。通常は留学生はFulltime,On campusにて学ぶこととなりますが、学生ビザではない場合、他の就学モードも受講が可能な場合があります。

Paragraph 6D101(d) precludes points being awarded for any study undertaken while enrolled at an educational institution in a designated regional area as a distance education student.

コースとの関連性と修了時期に関して

またこのポイントにおいて2020年9月1日現在の移民局内部の査定方針には以下の2事項に関係なく、上記の4項目が満たされていればポイントが発生するとされています。

• when the study was completed (provided it was completed prior to the date of invitation to apply for the visa); or
• whether the study is related to the applicant’s nominated skilled occupation.

どのタイミングでコースを修了したか、（EOIよりEnvitationが発行される前である、との仮定に基づく）

証明について/ Evidence　

指定地方エリアでの就学の証明に関しては成績証明書（Academic Transcript)もしくはコース修了証明書（Letter of Course Completion)

To confirm that the study component for this factor was completed in a designated regional area, decision makers should refer to the academic transcript or letter of course completion.

住居に関する証明に関しては賃貸借契約（不動産屋との契約書　Rental Agreement）、電話の請求書（Telephone Bills)、電気、ガス、水道の請求書、他を証明としてビザ申請時に提出すること。

To confirm the residence component, applicants should provide supporting documentation with their application such as, but not limited to, copies of rental agreements, telephone bills, or electricity/water/gas bills.

現在、Covid19の特別サポートとしてオーストラリア政府は学生ビザを保持した状態でCOVID-19の影響でやむをえず、海外からオンライン受講をせざるを得ない学生にはそのオンライン海外就学もAustralian Study Requirementにカウントする特例を発表しておりますが、地方ポイントに関する救済条件は公示されておりません。気になる方は常に移民局の最新情報をこちらのサイトで確認することをお勧めいたします。

Temporary Graduate (Subclass 485) visa eligibility

We have changed the requirements for a Temporary Graduate (subclass 485) visa for those who have been impacted by COVID-19:

• online study undertaken outside Australia as a result of COVID-19 travel restrictions will count towards the Australian Study Requirement for existing and new student visa holders

This change is available now.
